Terms of Service

These Terms govern your use of Pwnkemon ("the Service"), operated by Pwnkemon ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Pwnkemon is an automated penetration-testing platform. You request scans against targets you have verified ownership of; our agent runs assessment tools and produces a report. The Service is provided "as is" without warranty of any kind.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter a binding contract. If you are using the Service on behalf of an organisation, you confirm you are authorised to bind it to these Terms.

3. Account & authentication

We authenticate accounts via Clerk. You are responsible for keeping your login credentials and any API tokens you issue confidential. You are liable for all activity carried out under your account, whether or not you authorised it personally.

4. Target authorisation

You may only scan targets you own or have explicit written authorisation to test. Verifying a target through our DNS or HTTP challenge constitutes your representation that you have such authority. Unauthorised scanning is a criminal offence in most jurisdictions (including, in the UK, under the Computer Misuse Act 1990). See our Acceptable Use Policy for the full rules.

You indemnify us against any claim, loss or expense arising from your scanning a target you were not authorised to scan.

5. Plans, billing & refunds

Paid plans are billed in advance. Subscription fees are non-refundable except where required by law. You may cancel at any time from the dashboard; cancellation takes effect at the end of the current billing period.

Pwnkemon may change pricing on 30 days' notice; the changes take effect on your next renewal.

6. Usage limits

Each plan has limits on the number of scans, verified targets, and associated features. Limits are published on the pricing page and the limits documentation. We may rate-limit or suspend accounts that breach these limits, abuse the Service, or appear to be operated for malicious purposes.

7. Acceptable use

You must not use the Service in any way prohibited by our Acceptable Use Policy. Violations may result in immediate suspension or termination without refund.

8. Data & reports

Scan reports and findings produced through the Service are your data. We process them on your behalf to deliver the Service. See our Privacy Policy for how we handle personal and scan data.

9. Intellectual property

The Pwnkemon software, branding, documentation, and underlying systems are our intellectual property. You receive a non-exclusive, non-transferable licence to use the Service in accordance with these Terms. You retain all rights to your own data and reports.

10. Disclaimers

Automated penetration testing is not a substitute for a comprehensive manual security review. Findings produced by the Service are best-effort, may include false positives or false negatives, and should be independently verified before reliance is placed on them. We make no guarantee that the Service will detect every vulnerability in a target.

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from or relating to the Service is limited to the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) £100. We are not liable for indirect, consequential, incidental or punitive damages.

12. Suspension & termination

We may suspend or terminate your account if you breach these Terms, the AUP, or if your use of the Service threatens its security or stability. You may terminate by cancelling your subscription and deleting your account from the dashboard.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or in-app at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

14. Governing law

These Terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

These Terms are provided as a working baseline. They have not yet been reviewed by a solicitor; specific clauses (in particular limitation of liability and indemnity language) are likely to be amended before general availability. Existing customers will be notified of any substantive change ahead of the effective date.
